Uri, Jan 24 (GNS): A court in Uri has rejected bail application of person accused of stalking and harassing a girl in the north Kashmir area.

Court of Judicial Magistrate Ist Class, Fozia Paul, rejected the bail plea of the accused Ishfaq Ahmad of NalusahMohara Boniyar, underlining that the investigation was at its infancy and there was every apprehension that he would repeat the offense. “Further the report from the FSL is awaited, therefore, it is not the proper stage to release the accused on bail,” the court said after hearing counsel for the accused as well as prosecution.

According to the girl’s statement, the accused has been stalking, harassing and threatening the victim and her family.

“Moreover, the victim has also claimed that the accused has been uploading video of the victim on social media and therefore causes a serious threat to the dignity of the victim,” the court said as per an order, a copy of which lies with GNS.

Earlier, counsel for the accused said the police station Uri on a “false, baseless, fabricated and malicious” complaint registered the case against Ishfaq.

On the other hand, the plea for the bail was resisted by the prosecution on the grounds that the accused was “involved in non-bailable offences, which are heinous in nature and as such cannot claim bail as a matter of right.”

“If he is released on bail, he will try to tamper with PWs and there is every-likelihood of his absconding,” the prosecution said, adding, “The accused has committed an offence against the society and the society at large has been annoyed.”

It said that the investigation of the case was incomplete and the concession of the bail if exercised at this stage will have an adverse effect. (GNS)
