Admin Imposes Section 144 In Baramulla

Office of the District Magistrate Baramulla ordered the General Election to the Lok Sabha 2024 for 1-Baramulla Parliamentary Constituency is scheduled to be held on 20.05.2024;

It is essential to conduct the General Election in free and fair manner and to maintain public peace, order and tranquillity as per provisions of Law and Model Code of Conduct as applicable with effect from 6:00PM 18-05-2024(48 hours before close of Poll).

There is possibility of political disputes, confrontation, violence and breach of peace during poll which may result in public nuisance and law & order Problems thus causing damage to human life and property;

The undersigned is satisfied that the circumstances do not permit the serving in due time of the notices individually upon the persons against whom this order is directed and therefore, under the powers vested in him under Sub-Section (2) if Section 144 of Criminal Procedure code, 1973 hereby pass the order ex-parte;

Now, therefore, I Minga Sherpa IAS, District Magistrate Baramulla in exercise of the powers vested in me under Sub Section (1) of Section 144 of Criminal Procedure Code, 1973, do hereby issue following prohibitory order with effect from 06:00PM today i.e. 18-05-2024, till 21.05.2024(P+1)

  • (a) There shall be complete ban on holding of public meetings.
  • (b) There shall be complete ban on gathering of 5 or more persons;
  • (c) There shall be complete ban on use of loudspeaker(s);
  • (d) Any other prohibitions as envisaged in Hon’ble ECI’s instructions & guidelines to be observed during the 48 hours silence period.
  • (e) All Political functionaries/party workers who are not voter in 1-Baramulia Parliamentary Constituency shall leave the District by or before 6:00 PM, 18th May 2024 l.e., after campaigning period is over.

This order shall not apply to;

  • (1)Public servant on duty and to bonafide marriage or funeral processions or any other such function.
  • (ii) Also, this order shall not apply to the Police, Paramilitary, Centre armed police, and Military or any other Govt. Employees on official duty, and
  • (iii) Door to Door campaigning by the Candidates/Political Parties.

Failure, to comply with this order shall be liable for necessary action under Section 188 of Indian Penal Code, 1860 and other relevant provisions of law in force.

Sr. Superintendent of Police Baramulla/Sopore and all Executive Magistrates of District Baramulla are directed to implement the order in letter and spirit.
