The Union Government on Thursday apprised the Supreme Court that it cannot give an exact timeline for the restoration of Jammu and Kashmir’s statehood but it is ready to conduct elections. It also clarified that the Union Territory status of J&K is temporary.

Furthermore, the Centre shared encouraging security-related statistics. Solicitor General Tushar Mehta informed the court that instances of militancy have decreased by 45.2% between 2018 and 2023. Infiltration has seen a substantial reduction by 90%, while law and order issues like stone pelting have been significantly curbed by 97%. The casualties among security personnel have reduced by 65%, showcasing an improved security environment.

‘5,000 people in house arrest’, there cannot be any bandh: Kapil Sibal

Advocate Kapil Sibal, representing petitioners, said, “If you have 5,000 people in house arrest and withs section 144 imposed there cannot be any bandh, so let us not get into this.

To which, Chief Justice of India Chandrachud said, “What he is saying is that the roadmap to full statehood will take some time. UT is not a permanent feature and there cannot be a timeline but these are the steps they are taking, but we know these facts cannot be an answer to the constitutional question.”

Correct people are under house arrest’ in J&K: Mehta

Kapil Sibal: The problem is this is being televised and all of this is on record. They make it look like what all government is doing.

Kapil Sibal: 5000 were under house arrest. Let us not make a mockery of democracy. Section 144 was imposed and the internet was shut off, This court has recognised all of this as well. People could not go to hospitals, even, let us not talk about bandhs.

Centre on J&K’s statehood

Solicitor General Tushar Mehta told the Bench that “Union Territory is a temporary phenomenon and we need to infuse certain things so that the state becomes a state in the real sense.”

“I am unable to give an exact timeframe for when this will be completed,” he added.

“Projects have increased in Jammu and Kashmir and this has been gaining a boost and youth are getting employed,” Mehta said.

Stone pelting incidents ‘nil now’

The Centre further told the Bench that since 2018, the Valley has recorded 1767 stone pelting incidents. “In 2023 it’s nil now,” S-G Mehta said.

He further told the Supreme Court that “organised bandhs” in 2018 stood at 52 and today it is “nil”.

‘Terrorist activities reduced by…’: Centre

S-G Tushar Mehta told the Bench that terrorist activities have decreased in Jammu and Kashmir by 45.2 per cent post-2019. He said that infiltration has been reduced by 90.2 per cent.

‘Second election would be municipal elections’

Tushar Mehta told the Bench that the second polls in J&K would be that of local civic bodies.

 

Centre cites J&K’s law and order since 2018

Solicitor General Tushar Mehta highlighted that the process of hill development in J&K is underway and that “it will be held soon”.

“For kargil and leh where hill development will be held,” he said.
